Article 1 - Duration of Stay

The client signing this contract, which is concluded for a fixed duration, may under no circumstances claim any right to remain on the premises at the end of the stay.

Article 2 - Responsibility

The owner who offers services to a client is the client's sole point of contact and is responsible to them for fulfilling the obligations arising from these terms of sale. The owner cannot be held responsible for unforeseen circumstances, force majeure, or actions of any person not involved in the organization and conduct of the stay.

Article 3 - Booking

The reservation becomes firm when the owner receives a deposit of 25% of the total price of the stay (including administrative fees) and a signed copy of the contract from the client, before the deadline indicated on the contract.

Article 4 - Balance Payment

The client must pay the owner the remaining balance of the agreed service one month before the start of the stay. A client who has not paid the balance by the agreed date is considered to have cancelled their stay. The service will then be offered for sale again and no refund will be made.

Article 5 - Late Bookings

For bookings made less than 30 days before the start of the stay, the full payment will be required at the time of booking.

Article 6 - Arrival

The client must arrive on the specified day and at the times mentioned in this contract. In case of late or delayed arrival or last-minute impediment, the client must notify the owner whose address and phone number appear on the contract.

Article 7 - Cancellation by the Client

Unless specified in the special conditions of the contract, the following cancellation conditions apply:

Any cancellation must be notified by registered letter to the owner. The amount refunded to the owner, excluding administrative fees, will be as follows:
• cancellation more than 30 days before the start of the stay: 10% of the stay amount will be retained
• cancellation between the 30th and 21st day inclusive before the start of the stay: 25% of the stay price will be retained
• cancellation between the 20th and 8th day inclusive before the start of the stay: 50% of the stay price will be retained
• cancellation between the 7th and 2nd day inclusive before the start of the stay: 75% of the stay price will be retained
• cancellation less than 2 days before the start of the stay: 90% of the stay price will be retained
In case of no-show by the client, no refund will be made.

Article 8 - Modification of a Substantial Element

When, before the planned start date of the stay, the owner is forced to modify one of the essential elements of the contract, the buyer may, after being informed by the seller by registered letter with acknowledgment of receipt:

- either terminate their contract and obtain immediate refund of amounts paid without penalties
- or accept the modification: an amendment to the contract specifying the modifications made is then signed by the parties.

Any price reduction will be deducted from any amounts still due by the buyer, and if the payment already made by the latter exceeds the price of the modified service, the excess will be returned to the tenant before the start of their stay.

Article 9 - Cancellation by the Owner

When, before the start of the stay, the owner cancels this stay, they must inform the buyer by registered letter with acknowledgment of receipt.

The buyer will be immediately refunded all amounts paid, without penalties.

Article 10 - Interruption of Stay

In case of interruption of the stay by the client, no refund will be made.

Article 11 - Capacity

This contract is established for a maximum capacity of people. If the number of vacationers exceeds the accommodation capacity, the provider may refuse additional clients. Any modification or breach of contract will then be considered at the client's initiative.

Article 12 - Assignment of Contract by the Client

The buyer may assign their contract to an assignee who meets the same conditions as them to make the stay. In this case, the buyer must inform the owner of their decision by registered letter with acknowledgment of receipt at least 7 days before the start of the stay.

The contract assignment must be made at cost price. The assignor and the assignee are jointly and severally liable to the seller for the payment of the balance of the price as well as any additional costs occasioned by this assignment.

Article 13 - Insurance

The client is responsible for all damages occurring through their fault. They are required to be insured by a holiday-type insurance contract for these various risks.

Article 14 - Inventory

An inventory is established jointly and signed by the tenant and the owner or their representative upon arrival and departure from the accommodation. This inventory constitutes the only reference in case of dispute concerning the condition of the premises.

The tenant is required to enjoy the rented property as a good head of household.

The cleanliness of the accommodation upon the tenant's arrival must be noted in the inventory. The cleaning of the premises is the responsibility of the vacationer during the rental period and before departure.

The amount of any cleaning fees is established based on the calculation mentioned in the description sheet.

Article 15 - Security Deposit

Upon the client's arrival at a rental property, a security deposit, the amount of which is indicated in the special conditions of the contract, is requested by the owner. After the joint establishment of the departure inventory, this deposit is returned no later than 15 (fifteen) days following the planned end date of the stay, minus the cost of restoring the premises if any damage was noted.

In case of early departure (prior to the times mentioned in the description sheet) preventing the establishment of the inventory on the same day as the tenant's departure, the security deposit is sent by the owner within a period not exceeding two weeks.

Article 16 - Payment of Charges

At the end of the stay, the client must pay the owner for charges not included in the price. Their amount is established based on the calculation mentioned in the description sheet and a receipt is provided by the owner when the client requests it.

Article 17 - Disputes

In case of dispute, the parties will endeavor to find an amicable agreement.

If it is impossible to reach an agreement, the matter will be brought before the competent courts in the matter.
